This Request for Proposal (RFP) is for delivery of physical firm energy to PNGC Power (PNGC). PNGC intends to replace existing market purchases with physical energy from resources and to include said energy in its supply portfolio to serve its firm load obligations.

Term

  1. October 1, 2023 to September 30, 2028 (5-year duration)

All proposals will be considered; however, preference will be given to those proposals with a term matching this RFP.

Product

A minimum of 40 MWs up to 75 MWs per hour for all hours (ATC) of the 5 year term.
As generated energy from physical resource with shaping and/or balancing services to deliver a flat block of energy. Energy must be delivered on a flat hourly schedule on a Pre-Schedule basis, and delivered volumes must remain constant throughout the entire duration of the term.

Terms and conditions of agreements for the desired product(s) will be in accordance with WSPP Agreement, Service Schedule C, Firm Energy. Terms shall include liquidated damages.

Price Structure

PNGC Power strongly prefers a fixed price structure. PNGC expects to see bid prices for each individual year. However, if bidders prefer, a flat price for the entire term can also be submitted as a supplement.

Point(s) of Delivery (POD)

PNGC Power is a network customer of BPA Power. As such, PNGC can acquire network Transmission at any POD on BPA’s transmission and deliver to load at no cost to the bidder – Providing sufficient ATC is available to grant the request. Bidders shall state the appropriate BPA POD in their responses, and PNGC can determine if a Network Transmission Request can be granted prior to entering the short list evaluation period.

If PNGC’s Network Transmission is unavailable and/or the resource is outside the BPA BA:

Seller shall be responsible for acquiring and paying for firm transmission service to the Point(s) of Delivery specified below:

  • Mid-C hub – NWH, MIDREMOTE, COLMARKET, BPAT.CHPD, BPAT.DOPD, BPAT.GCPD

Bidder Qualifications

As applicable, the bidder must provide documentation, satisfactory to PNGC, that it is authorized under the law to sell power, and able to schedule power and operate under industry standards established by the Federal Energy Regulatory Commission (FERC), Western Electricity Coordinating Council (WECC), and the North American Energy Reliability Council (NERC), or other applicable regulatory body or government agency. The bidder must also be a WSPP member.

  • Shortlist Bidder(s) Notified — April 8, 2022
  • Shortlist Evaluation Period/Final Offers — April 9, 2022 to April 29, 2022
  • Final Negotiation/Agreement Execution — May 4, 2022 to May 18, 2022

Selection Process

All offers received by the specified date will be evaluated in a non-discriminatory, non-preferential, and consistent manner. Selected Bidder(s) will be notified by April 8th, 2022.

It is PNGC Power’s intent to finalize a definitive agreement as soon as possible with the entity(ies) that provide, in PNGC Power’s sole judgment, the best combination of power supply characteristics and costs. PNGC Power recognizes it may be necessary for bidders to refresh their bid price for final consideration. During the evaluation process PNGC Power will notify bidders of the deadline for any refreshed bids. PNGC Power in its sole discretion may discontinue negotiations with a bidder at any time.

Confidentiality

PNGC Power will use reasonable efforts to protect any proprietary and confidential information contained in a proposal, provided that such information is clearly identified by the bidder as “Proprietary and Confidential” on the page on which proprietary and confidential information appears.

Credit

PNGC Power reserves the right to require adequate credit assurances in compliance with PNGC Power’s risk management policies and procedures and limits for exposure to counterparties, which may include, but not limited to, margin provisions, cash collateral, a corporate parental guaranty, and/or a letter of credit in a form, amount, and from a financial institution acceptable to PNGC Power.

Rejection or Selection of Proposals

PNGC Power reserves the right to reject any or all proposals, or re-solicit for proposals, or modify this proposal, based upon PNGC Power’s sole judgment.

This RFP is an invitation to submit offers and shall not be construed as a limitation on PNGC Power accepting and entering into an agreement to purchase energy that was not submitted pursuant to this RFP.

In the event a definitive agreement cannot be reached with a bidder, PNGC Power reserves the right to accept the proposal of any other bidder or to seek additional proposals.

Limitation of Liability

PNGC Power shall not be liable for any expenses bidder incurs in connection with providing a response to this RFP, or for any costs, fees, or lost or foregone profits of unsuccessful proposals.
